Winley Ford Secure Acquittal in Dangerous Dog Case

Winley Ford Solicitors and Hugh McKee at 23 Essex Street Chambers were recently instructed to represent a client at Preston Crown Court charged with being the owner of a dog which caused injury while dangerously out of control in a public place.


The allegation was that the defendant and the complainant were both out walking their dogs. The defendant's dog approached the complainant's dog and began snarling at it. The complainant bent down to pick up her dog and as she did so the defendant's dog jumped up several times causing scratches and a bite mark to the complainant.


An expert report was obtained which set out an analysis of the dog's behaviour.


Issues were raised before and during the trial as to the lack of evidence in respect of the identity of the dog that had caused the bite mark. A successful submission of no case to answer was made by the Defence at the conclusion of the Prosecution case on that basis.
